A Trump-appointed planning commission approved the arch 8-4 Thursday night. Hours later, Judge Tanya Chutkan sided with D.C., Virginia and a group of Vietnam veterans.

The short version

  • The National Capital Planning Commission approved the arch 8-4 after a roughly 9½-hour hearing where many witnesses opposed it, AP reported.

  • Chutkan's temporary restraining order bars construction for 14 days. Her 33-page ruling says the challengers are likely to show the government skipped required legal steps.

  • Congress has not appropriated any money for the arch. The government must file a status report Monday showing it is complying.

WASHINGTON — A federal judge late Thursday temporarily blocked construction of President Donald Trump's 250-foot triumphal arch, hours after a planning commission gave the project its final approval, The Associated Press reported.

U.S. District Judge Tanya Chutkan's restraining order halts work for 14 days. The arch would sit at Memorial Circle, between the Lincoln Memorial and Arlington National Cemetery.

What the judge ruled

In a 33-page ruling, Chutkan wrote that the challengers are likely to succeed in showing the government did not follow required legal processes before moving to build, CBS News reported.

The administration says a 1925 law cleared the way for a monument at the site. Chutkan called it improbable that a century-old statute held authority "unknown to every previous administration," AP reported.

The ruling came in lawsuits brought by the District of Columbia and Virginia. Chutkan put off ruling on a related lawsuit from Vietnam War veterans who say the project still lacks congressional authorization, MS NOW reported.

How the commission voted

The National Capital Planning Commission approved the arch 8-4. The vote split along federal and local lines: those in favor work for the administration or are connected to Trump, AP reported. Chairman Mark Paoletta is a White House budget office official.

D.C. Council Chairman Phil Mendelson, a commission member, argued that Congress has never approved the project or paid for it. He also noted the submitted plans leave out the military uses Trump has described.

In September, Trump said the arch would be a "top grade Military Complex" housing drones and sniper ammunition, CBS reported. The final plans make no mention of it.

What the White House says

White House spokesperson Davis Ingle praised the commission's approval Friday morning on X. The Justice Department declined to comment on the ruling, MS NOW reported.

The administration had said work could start as soon as the approval came through. Chutkan has ordered the government to file a status report Monday.

The fight moves to a Democratic Congress in January. Rep. Jared Huffman, an arch critic, is set to chair the House Natural Resources Committee, AP reported. FMNN's look at Democrats' oversight plans is here.
